What Is Considered An Aggravated DUI In Kentucky?

There are a few different ways to face aggravated DUI charges in Kentucky:

  • Having a high BAC that is at least 0.15%. For reference, the legal limit for most drivers is 0.08%, so this is almost twice the legal limit.
  • Having prior convictions on your record.
  • Causing a DUI accident that leads to the injury or death of another person.
  • Refusing to take a breath test. While you do have a right to refuse a test, under implied consent laws, this is still a legal violation and could be used as an aggravating circumstance that escalates the penalties.
  • Having a child who is under 12 in the car with you at the time of the arrest.
  • Committing other offenses, such as speeding. For example, going 30 mph over the speed limit while under the influence could lead to aggravated DUI charges.
  • Operating a vehicle with a suspended or revoked license, especially if it is from a previous DUI charge.

The penalties for aggravated DUI charges can be far more significant in Kentucky. A first offense could lead to 30 days in jail, while a second offense could lead to six months, and a third offense could lead to up to 12 months. The fine for a first offense is from $200–$500, but the minimum increases to $350 for a second offense, and fines for a third offense range from $500–$1000. You may also receive a suspended license or be required to go to treatment programs or use an ignition interlock device.
